Terms of Business

Overview

I act only on the basis of these Terms of Business and the Privacy and Confidentiality Notice which can be seen on this website.

Our Terms

My role as a Notary in England and Wales

Unless I have prepared the documents then my role is limited to ensuing that documents are executed in accordance with English law and any additional specified requirements of the country of destination. 

This will include establishing your identity, legal capacity, and authority; that you understand the documents and their effect and that you agree to be bound by them.

Additionally, I may may be required to verify particular facts in the documents or the authenticity of supporting documents: this may require independent evidence or proof from sources other than the client.

 

Regulation of Services

My practice is regulated by the Faculty Office of the Archbishop of Canterbury.

Liability and Insurance

I maintain professional indemnity insurance in accordance with the requirements of the Faculty Office, details of insurance and territorial coverage of the policy are available for inspection upon request.  My maximum liability is limited to GBP 750,000.

Ceasing to act

In some circumstances and at my sole discretion, I may consider that I should decline or cease to act: for example, if I do not receive clear or proper instructions, or if the matter appears to be fraudulent or unlawful, or if my charges are not paid.  

Legal advice

As an English qualified lawyer, I cannot give advice on how the document will be interpreted or enforced in the foreign country of destination.
